FASSAI [Food License]
Any entrepreneur who wants to start a business in the food sector, be it food processing or food manufacturing, packaging or distributing, has to register for Food Safety and Standard Authority of India (FSSAI). What is FSSAI?
Food Safety and Standards Authority of India (FSSAI) is an independent body recognised under the Ministry of Health & Family Welfare, Government of India. The FSSAI has been established under the Food Safety and Standards Act, 2006 which is a consolidating statute related to food safety and regulation in India. FSSAI is responsible for protecting and promoting public health through the regulation and supervision of food safety.
The main aim of FSSAI is to regulate and check for safe food manufacturing, storage, and handling practices by Food Business Operators (FBOs). A FSSAI registration certificate comes with a 14-digit License number to FBOs which is required to be printed on all the food products with FSSAI logo. The license can be applied for a minimum 1 year to maximum 5 years; it can again be renewed or re-applied as per rules stated under Food Safety & Standards Act, 2006.

For all food-related businesses such as manufacturing, trading, restaurants, small eateries, grocery shop, importers, exporters, home-based food businesses, dairy farms, processors, it is mandatory to get an FSSAI license or FSSAI registration before commencing with the Company. This 14 digit FSSAI license number gives information about the producer’s permit.
Validity of FSSAI License
FSSAI license issued to food businesses are valid for a period of minimum 1 year to maximum 5 years. It can again be renewed or re-applied as per rules stated under Food Safety & Standards Act, 2006.
It is mandatory to apply for license renewal within 30 days before the expiry of the existing license. Non-renewal of licenses can fetch a fine of Rs. 100 per day until the renewal is done. Any lapse in renewal within the stipulated date can result in the old license becoming defunct and businesses will have to apply for a fresh license.

A Central License is required for the Registered Office or Head Office for a Food Business Operator (FBO) operating a food business premises located in two or more than two States – this is in addition to license/registration for each unit/premise. These Separate license or registration will need to be obtained from the Central or State licensing authorities, depending upon that unit’s capacity or turnover.
10. I am importing food items for selling in India even then it requires FoSCos Food License?
Yes, you will be needed to get a Central License for the specific address that is notified in the Import Export Code (IEC). For any import-export related business operation, FSSAI Central License is necessary.
11. Can I transfer my FSSAI License to someone else?
In case of the death of the FSSAI License holder, the FSSA License can be shifted to the legal representative or any family member of the dead holder. The legal representative or the family member needs to apply to the concerned Authority to shift the license in his/her name.
12. I am planning to sell some Homemade food items online on a small scale, do I need to get a FSSAI enabled FoSCos License?
Yes. You require having an FSSAI registration to sale homemade stuff on an online platform particularly if your business is on a small scale, and the annual turnover is among 0-12 Lakhs.
13. How can I make changes to my existing FSSAI Certificate?

14. Is the FoSCos license needed for a catering business authorized by the Central Government?
It is mandatory for all catering establishments in India. Even the Indian Railways, Defense units, and Airports require this license as well.
15. Will I require different Licenses if I am conducting different type of food business activities at the same premise?
Please note, the online FSSAI license is based and granted on premises – hence every kind of food business being operated from the same premise can be applied in a single FSSAI license.
16. Is FSSAI License required for utensils/packaging material used for serving or packaging of food?
No, not required. Utensils/packaging materials are not covered under the definition of food as per Section 3(n) of FSS Act, 2006 – so FSSAI License/Registration is not required.
17. For 100% export units, is it mandatory to take FSSAI License?
FSSAI license is mandatory for both – export and import of food products. Hence the FSSAI Central License is required for the export unit.
18. Do medical stores need to get a license if they are selling dietary foods and Nutraceuticals?
All FBO including medical stores have to get FSSAI license/registration.
19. Am I required to file annual return for my food business activities?
Yes – FSSAI Licensed FBOs who manufacture (including repacking and manufacturing of food products by third party manufacturers) and import food products need to submit Annual Returns in Form D1 by 31st May of every preceding financial year. Manufacturers of Milk and Milk products should submit Half-yearly returns in form D2 within one month of completion of previous half-year. Formats of D1 and D2 can be availed from the homepage of FSSAI licensing website. Merchant Exporter can file Quarterly annual report online.
20. When should I get the FSSAI License renewed?
The FBO (Food Business Operator) requires filing a renewal application within 30 days before the expiry of the license. The renewal application filed after the expiry of 30 days will attract a penalty of Rs. 100/- per day till the submission of the renewal application. The renewal option will be available to FBO 120 days prior to the expiry of the valid license.
21. What will happen if I forget to renew my Food License?
In case of forgetting to make a renewal of a food license, you have to pay a penalty of Rs. 100 per day within the specified validity time. Following that, your existing food license can be cancelled and need to apply for a fresh license.
