    International Trademark Registration

Trademark registration is territorial. This means that for each country that you wish to be present in, you must make a separate trademark application. As, most often, the party that makes the trademark application owns the trademark, it is important that you proceed at speed. It is imperative to note that a national trademark registration ends at the country it’s registered in and in no way gives the owner of the trademark any rights outside the nation concerned.

International trademark registration application under the Madrid Protocol must be filed by the trademark applicant through the trademark office of the applicant, known as the office of origin. In case of Indian Businesses, the Office of Registrar of Trademark, India is the office of origin. The office of origin will process the trademark application and file it with the Intellectual Property Organization at Geneva. If the trademark application is found fit, then the mark is recorded in the International Register and published in the World Intellectual Property Organization (WIPO) Gazette of International Marks.

Once an international trademark is registered under the Madrid Protocol, the mark is registered for 10 years. International trademark registrations can be renewed at the end of the 10 year period directly through WIPO or through the concerned office of origin.

    What is the Madrid System?

The Madrid System is a system for the international registration of marks. It provides a means to simultaneously seek protection for a trademark in a large number of jurisdictions. The system is governed by two separate international treaties, the Madrid Agreement (Agreement) and the Madrid Protocol (Protocol). Under the Agreement, nationals of any signatory may secure protection of their trademark, registered in the country of origin, in all other states that are parties to the Agreement. Under the Protocol, nationals of any signatory may secure protection in countries and jurisdictions that are contracting parties to the Protocol based on a pending application or registration in the country or jurisdiction of origin.

Both the Agreement and the Protocol are administered by the International Bureau of the World Intellectual Property Organization (WIPO). As of September 1, 2008, for countries bound by both the Agreement and the Protocol, only the provisions of the Protocol apply. Consequently, from that date, International Registrations are governed exclusively by the Protocol (1) in all jurisdictions that are party only to the Protocol and (2) in those jurisdictions that are party to both the Protocol and the Agreement. The Agreement governs only those jurisdictions that are bound solely by the Agreement.

    Advantages of International Trademark Registration

    Business Opportunity

A trademark is an intangible asset that can be enormously valuable, should your brand succeed. Think of Tide, Nike or McDonald's. Businesses can earn huge money in royalties through licensing agreements or even transfer ownership to interested parties through assignment agreements.

    Legal Protection

If you believe your registered trademark is being infringed, it is easy to establish your right to it in court. If you haven't registered the word, slogan or logo, you would not be able to do so. Particularly in sectors in which piracy is rampant, trademark registration is essential.

    Unique Identity

You would want your customers to identify your products or services with yours business name only. Registering your trademark is the first step toward ensuring this objective. After registration, Even the court would not allow any similar words or slogans from being registered as Trademark.

    Effective Brand Management

By registering your brand internationally through Madrid protocol, you can manage your brand through a centralized system, and easily expand Business into new markets.

Cost effective / less time consuming

It provides a convenient, cost effective and less time-consuming way of trademark protection Internationally by filing one application. In case no objection is raised, the Trademark can get registered within a period of 18 to 20 months.

    Easy changes and Renewal

An International Trademark lasts for 10 years from the date of registration. However, Easy changes and renewal facility also available. One can renew the same with a simple application form to be submitted to WIPO.

    Prerequisites of International Trademark Registration

There are three main requirements for obtaining an international trademark registration in India:
    – The applicant should be a national of India or domiciled in India or have real and effective business or commercial establishment in India.
    – The applicant must have a national (Indian) trademark application or registration of a trademark with the Indian Trade Marks Registry. This national trademark application / registration will be used as the basis of the international application.
    – The applicant in the international application must choose one or more other member countries of the Madrid Protocol, where the applicant wants to protect his trademark.
